NOTE:  All Business Equipment filings must now be sent by fax to 540.667.6487 or by email to mprice@fcva.us.  Online BE filing is no longer available for 2023.

Contractors who have a business with a situs (physical location/definite place of business) in Frederick County

  • Set up business/determine name/register with State Corporation Commission if required:  Sole Proprietor  - Corporation - LLC - Partnership 
  • If not using your legal name as the business name:  file a Certificate of Assumed or Fictitious Name with the Clerk of the Circuit Court and provide us with a copy
  • Zoning Review & Approval Form: must be approved by Department of Planning & Development (540.665.5651)
  • File initial Business License Application:  see Business License Information website page
  • File Workers Comp Insurance Info Form:  State required ANNUAL info even if no insurance required 
  • File VA Contractor/Tradesman License Info Form (if licensed by DPOR/update upon expiration) OR Contractor Statement & Affidavit (file ANNUALLY if not State licensed)
  • File Business License Renewal Application: Due ANNUALLY by March 1
  • File Return of Tangible Personal Property/762B: for business equipment & furnishings such as ladders, hand-held tools, forklifts, backhoe, computers, phone, hair dryer, cribs, etc. (file ANNUALLY by March 1 even if no equipment [explanation necessary] or no change from prior year)
  • File other forms as applicable (Changes, Subcontractors, Closing etc.)

Contractors who are only doing a job(s) in Frederick County (out-of-jurisdiction contractors)

    If the total of all jobs to be performed in Frederick County will be less than $25,000, a Frederick County business license is NOT required.

    If the total of all jobs to be performed in Frederick County will be $25,000 or more, a Frederick County business license is required by filing all of the above as listed for Contractor with a business in Frederick County except:  
    • Zoning Review & Approval (not required)
    • Return of Tangible Personal Property (required to be filed ANNUALLY only if equipment located in Frederick County on January 1)
    • Gross Receipts Calculation form (additional requirement for you as an out-of-jurisdiction contractor)
