1. The sale of any parcel is subject to the approval and confirmation of the Circuit Court of Frederick County.
2. The Special Commissioner of Sale reserves the right to withdraw from sale any property listed and to reject any bid by declaring "NO SALE" after the last bid received on a parcel.
3. A Bidder's Deposit or ten percent (10%) of the purchase price, whichever is greater, by cash, cashier's or certified check is due when the Auctioneer declares the sale. Terms of the Auction will be posted by the Special Commissioner at the time of advertisement.
4. All successful bidders must certify that they are not the owner of any other property in Frederick County on which there are delinquent taxes, zoning or other violations.
5. Properties are offered "as is", with all faults and without warranties either expressed or implied.
6. The costs of any title search and all recording costs will be at the expense of the purchaser. Property will be conveyed by Special Warranty Deed.
7. Announcements made the day of sale take precedence over any prior verbal or written terms of sale.
The Special Commissioner represents that information regarding the properties, including acreage, is only from the land records and is not guaranteed for either its completeness or accuracy. Bidders should make their own investigation to determine the suitability of each parcel and to bid accordingly. Any costs incurred by a bidder to inspect or investigate any property are the bidder’s responsibility and are not reimbursable.
